Former Canucks on board for Hockey Day in Canada

Vancouver Canucks alumni Cliff Ronning, Dave Babych, Darcy Rota, Jack McIlhargey and Garry Valk will relive their glory days at the second annual Richmond Celebrates Hockey Day on Saturday, Feb. 9 at the Richmond Olympic Oval.

Ronning, Valk, and Babych will lead the Vancouver Canucks Alumni as they hit the ice to take on the Richmond Sockeyes Alumni. Additional Canuck alumni participants will be announced in the coming weeks. Game time is 4:30 p.m. on Saturday, February 9. Tickets are $15 and are available at www.brownpapertickets.com or at the door. Partial proceeds from ticket sales will benefit Richmond Kidsport.

?All things hockey under one roof? is the theme for Richmond Celebrates Hockey Day, a day-long festival of every hockey activity imaginable under the Oval?s iconic, 2-hectare (6.5 acre) pine-wood roof. All activities are free with the exception of the Canucks Alumni game. Donations of non-perishable food items for the Richmond Food Bank will be collected at the event.

Back for an encore performance is the popular Celebrity Ball Hockey Game featuring a mix of notable athletes, media personalities and members of Richmond City Council. Former Canucks stars Darcy Rota and Jack McIlhargey will be among the participants.

A special appearance by Hockey Hall of Famer Guy Lafleur headlines this year?s event. One of the most exciting and outstanding players of his era, Lafleur led the Montreal Canadiens to five Stanley Cup victories and won numerous individual National Hockey League awards and other accolades. In addition to playing in the Celebrity Ball Hockey game, Lafleur will participate in a public autograph signing session and other activities.

For the second straight year, the current Richmond Sockeyes will take to the Oval ice for a Pacific International Junior Hockey League game, taking on the Aldergrove Kodiaks in a matinee match-up.

Former Illinois Governor Ryan leaves prison

(Reuters) - Former Illinois Governor George Ryan was transferred to home confinement on Wednesday after spending five years in federal prison, a U.S. Bureau of Prisons spokesman said.

Ryan, a Republican, was convicted in 2006 of racketeering, fraud and other offenses involving favoritism and kickbacks for state contracts and property leases. He was sentenced to 6-1/2 years in jail.

Ryan, 78, was released from a federal prison in Terre Haute, Indiana, and reported to a halfway house in Chicago, Bureau of Prisons spokesman Ed Ross said. Shortly afterward he was put under house arrest.

"I can confirm that he has transferred to house confinement today," Ross said. He did not say where Ryan was to be confined.

Ryan's release date is July 4. House confinement calls for a prisoner to remain at his home during non-working hours, Ross said.

Ryan's successor in office, Rod Blagojevich, in March began serving a 14-year sentence at a Colorado prison on corruption charges.

Michael Trimble, a British professor at the Institute of Neurology in London, begins his new book with Gana the gorilla. In the summer of 2009, 11-year-old Gana gave birth to a boy at a Muenster zoo. But one day in August, the baby suddenly and mysteriously died. Gana held up her son in front of her, staring at his limp body. She held him close, stroking him. To onlookers it appeared that Gana was trying to reawaken him, and, as the hours passed, that she was mourning his passing. Some at the zoo that day cried. But Gana did not. Humans, Trimble tells us, are the only creatures who cry for emotional reasons. ?Why Humans Like to Cry? is an exploration of why this would be so, a neuroanatomical ?where do tears come from.? It?s also a meditation on human psychology. Many distinctions have been offered between humans and the rest of the animal world, and to this list Trimble adds another: the anguished tear, the apprehension that life is tragic. Trimble answered questions from Mind Matters editor Gareth Cook.

Cook: How did you first become interested in crying?
Trimble: Of course, because I cry, and some things bring tears quite easily, notably music, and opera with the power of the human voice.
Crying tears, for emotional reasons, is unique to humans. There has been a game of catch me if you can, which has been played by those interested in finding attributes or behaviours which separate humans from our nearest living relatives ? namely the chimpanzees and bonobos. Certainly our propositional language is very special, but primate communities have very sophisticated ways of communicating. Other contenders, such as play, using tools, or having what is called theory of mind (the sense that I know that others have a mind very like mine, with similar inclinations and intentions) have all been argued as unique to our species, but all these have been demonstrated, in some form, to be found in other primates. Emotional crying makes us human.

Cook: What is known about crying in the animal world?
Trimble: Tears are necessary to keep the eyeball moist, and contain proteins and other substances which maintain the eye healthy and to combat infection. Tearing occurs in many animals in response to irritants which get in the eye, and in some settings tears fall for simple anatomical facts. When an elephant is standing, tears run down the trunk, but when lying down, the flow is impeded and tears may be seen coming from the eyes. It may be that animals that are abused shed tears, from pain, although observations of this are rare.

Cook: How is crying different in humans?
Trimble: Humans cry for many reasons, but crying for emotional reasons and crying in response to aesthetic experiences are unique to us. The former is most associated with loss and bereavement, and the art forms that are most associated with tears are music, literature and poetry. There are very few people who cry looking at paintings, sculptures or lovely buildings. But we also have tears of joy the associated feelings of which last a shorter time than crying in the other circumstances.

Cook: What do you find most interesting about the neuroscience of crying?
Trimble: If it is the case that only humans cry emotionally, then there must have been a time in human evolution when tears took on an additional meaning to their hitherto biological functions , namely as a signal of distress, and a cipher for suffering. In my book I discuss at when in the past our ancestors may come to possess this trait. I suggest that this is connected with the dawning of self-consciousness, with the development of theory of mind, and the realisation that the self and others can disappear. Attachment emotionally to others, with the development of sophisticated facial gestures associated with suffering, and with loss and bereavement ensued. All this before the development of our elegant propositional language. The emotional responses became largely unconscious and innate, and identification of tears as a signal for such distress was an important addition the so called Social brain, the circuitry of which can now be identified in the human brain.
I also discuss the differences between the neuroanatomy of the human brain and that of chimpanzees and other closely related primates, which may explain our ability to respond emotionally with tears to the arts. The brain areas involved are widespread, but link our cerebral cortex especially anteriorly with those areas associated with the representation of emotion ? so called limbic structures and our autonomic system. The latter co-ordinates heart rate, breathing, and vocal output, all of which collaborate in the expression of emotion with tears.

Ford posts strongest pre-tax profit in over a decade

Ford Motor says it made the highest fourth-quarter pre-tax profit in more than a decade. It earned $1.7 billion last quarter, due largely to increases sales of trucks and SUVs and higher prices for all models.

That was 31 cents a share, beating Wall Street forecasts which had ranged from 25 to 28 cents.

For all of 2012, the automaker?s net income was $5.7 billion, down $307 million than a year ago. It excludes some special charges.

Revenue last quarter was $36.5 billion, up $1.9 billion from the same period a year ago. For 2012, revenue was $134.3 billion, down $2 billion from a year ago.

Trucks, mainly sold in North America, drove profits hard enough to overcome European losses ? which were substantial, and more than the maker had forecast just a few months ago.

The Detroit Bureau: Toyota officially reclaims global sales crown

In the quarter, Ford reported European losses of 732 Million, against a loss of $190 million the previous year. For all of 2012 Ford?s European loss climbed to $1.73 billion. The automaker had forecast about $1.5 billion when it discussed third-quarter earnings three months ago.

In North America, Ford said it made $1.87 billion in the quarter ? twice as much as the $889 million on it posted a year earlier. Revenue for the quarter was $22.1 billion, up $2.5 billion.

For the year, North American profit was $8.34 billion, before taxes.

The Detroit Bureau: 2013 care sales off to good start

Ford showed a preview of the 2015 F-150 at the Detroit auto show earlier this month, hoping to tempt prospective buyers into waiting instead of buying General Motors new Chevrolet Silverado or GMC Sierra, on sale first half this year.

Ford also wanted to raise doubts in shoppers? minds about spending now for Chrysler Group?s Ram pickup, revised for 2013 and winner of the North American Truck of the Year earlier this month, an award bestowed by 49 U.S. and Canadian auto journalists.

Ford had reported a loss of $468 million in Europe last quarter and warned that losses were mounting. The automaker has announced plans to close three European plants by 2014, but said last quarter that it would lose $1.5 billion in 2012 and again this year, and doesn?t expect black ink from European operations until about 2015.

(AP) ? The Boy Scouts of America may soon give sponsors of troops the authority to decide whether to accept gays as scouts and leaders ? a potentially dramatic retreat from an exclusionary nationwide policy that has provoked relentless protests.

Under the change now being discussed, the different religious and civic groups that sponsor Scout units would be able to decide for themselves how to address the issue ? either maintaining an exclusion of gays, as is now required of all units, or opening up their membership.

Monday's announcement of the possible change comes after years of protests over the no-gays policy ? including petition campaigns that have prompted some corporations to suspend donations to the Boy Scouts.

Under the proposed change, said BSA spokesman Deron Smith, "the Boy Scouts would not, under any circumstances, dictate a position to units, members, or parents."

Smith said the change could be announced as early as next week, after BSA's national board concludes a regularly scheduled meeting on Feb. 6. The meeting will be closed to the public.

The BSA, which celebrated its 100th anniversary in 2010, has long excluded both gays and atheists. Smith said a change in the policy toward atheists was not being considered, and that the BSA continued to view "Duty to God" as one of its basic principles.

Protests over the no-gays policy gained momentum in 2000, when the U.S. Supreme Court upheld the BSA's right to exclude gays. Scout units lost sponsorships by public schools and other entities that adhered to nondiscrimination policies, and several local Scout councils made public their displeasure with the policy.

More recently, amid petition campaigns, shipping giant UPS Inc. and drug-manufacturer Merck announced that they were halting donations from their charitable foundations to the Boy Scouts as long as the no-gays policy was in force.

Also, local Scout officials drew widespread criticism in recent months for ousting Jennifer Tyrrell, a lesbian mom, as a den leader of her son's Cub Scout pack in Ohio and for refusing to approve an Eagle Scout application by Ryan Andresen, a California teen who came out as gay last fall.

Tyrrell said she's thrilled for parents and their children who've been excluded from scouting and "for those who are in Scouts and hiding who they are."

"For me it's not just about the Boy Scouts of America, it's about equality," she told The Associated Press. "This is a step toward equality in all aspects."

Many of the protest campaigns, including one seeking Tyrrell's reinstatement, had been waged with help from the Gay & Lesbian Alliance Against Defamation.

"The Boy Scouts of America have heard from scouts, corporations and millions of Americans that discriminating against gay scouts and scout leaders is wrong," said Herndon Graddick, GLAAD's president. "Scouting is a valuable institution, and this change will only strengthen its core principles of fairness and respect."

The Scouts had reaffirmed the no-gays policy as recently as last year, and appeared to have strong backing from conservative religious denominations ? notably the Mormons, Roman Catholics and Southern Baptists ? which sponsor large numbers of Scout units. Under the proposed change, they could continue excluding gays.

Prior to Monday's announcement, the BSA conferred with some leaders of these religious groups, although there were no official statements as to how they would respond.

Said Sister Mary Ann Walsh, a spokeswoman for the U.S. Conference of Catholic Bishops, "The bishops hope the Boy Scouts will continue to work under the Judeo-Christians principles upon which they were founded and under which they have served youth well."

Were the change adopted, said Deron Smith, "there would no longer be any national policy regarding sexual orientation, and the chartered organizations that oversee and deliver Scouting would accept membership and select leaders consistent with each organization's mission, principles, or religious beliefs.

"BSA members and parents would be able to choose a local unit that best meets the needs of their families," he said. "Under this proposed policy, the BSA would not require any chartered organization to act in ways inconsistent with that organization's mission, principles, or religious beliefs."

The announcement came shortly after new data showed that membership in the Cub Scouts ? the BSA's biggest division ? dropped sharply last year, and was down nearly 30 percent over the past 14 years.

According to figures provided by the organization, Cub Scout ranks dwindled by 3.4 percent, from 1,583,166 in 2011 to 1,528,673 in 2012. That's down from 2.17 million in 1998.

The Boy Scouts attribute the decline largely to broad social changes, including the allure of video games and the proliferation of youth sports leagues and other options for after-school activities.

However, critics of the Scouts suggest that its recruitment efforts have been hampered by high-profile controversies ? notably the court-ordered release of files dealing with sex abuse allegations and persistent protests over the no-gays policy.

The BSA's overall "traditional youth membership" ? Cub Scouts, Boy Scouts and Venturers ? totaled 2,658,794 in 2012, compared to more than 4 million in peak years of the past. There were 910,668 Boy Scouts last year, a tiny increase from 2011, while the ranks of Venturers ? a program for youths 14 and older? declined by 5.5 percent.

In addition to flak over the no-gays policy, the Scouts have been buffeted by multiple court cases related to past allegations of sexual abuse by Scout leaders, including those chronicled in long-confidential records that are widely known as the "perversion files."

Through various cases, the Scouts have been forced to reveal files dating from the 1960s to 1991. They detailed numerous cases where abuse claims were made and Boy Scout officials never alerted authorities and sometimes actively sought to protect the accused.

The Scouts are now under a California court order, affirmed this month by the state Supreme Court, to turn over sex-abuse files from 1991 through 2011 to the lawyers for a former Scout who claims a leader molested him in 2007, when he was 13. It's not clear how soon the files might become public.

The BSA has apologized for past lapses and cover-ups, and has stressed the steps taken to improve youth protection policy. Since 2010, for example, it has mandated that any suspected abuse be reported to police.

Misconceptions about a popular pet treat

The American and Canadian researchers analyzed the caloric density and bacterial contamination of these popular items, made from the uncooked, dried penis of a bull or steer. They also administered a survey to pet owners to assess their knowledge of these treats.

The study, published in the January 2013 issue of the Canadian Veterinary Journal, examined 26 bully sticks purchased from retailers in the United States and Canada and made by different manufacturers.

A random subset of the 26 bully sticks was tested for caloric content. These bully sticks tested contained between nine to 22 calories per inch, meaning the average six inch stick packed 88 calories--nine percent of the daily calorie requirements for a 50-pound dog, and 30 percent of the daily calorie requirements for a 10-pound dog.

"While calorie information isn't currently required on pet treats or most pet foods, these findings reinforce that veterinarians and pet owners need to be aware of pet treats like these bully sticks as a source of calories in a dog's diet," said Lisa M. Freeman, DVM, PhD, DACVN, professor of nutrition at TCSVM who is board-certified by the American College of Veterinary Nutrition.

Freeman was first author on the paper. Co-authors were J. Scott Weese, professor in the Department of Pathobiology at the University of Guelph, and Nicol Janecko, a research associate at the Canadian university.

"With obesity in pets on the rise, it is important for pet owners to factor in not only their dog's food, but also treats and table food," Freeman added.

All 26 treats were tested for bacterial contaminants. One (4 percent) of the sticks was contaminated with Clostridium difficile; one (four percent) was contaminated with methicillin-resistant Staphylococcus aureus (MRSA), a type of staph bacteria that is resistant to certain antibiotics; and seven (27 percent) were contaminated with Escherichia coli, including one tetracycline-resistant sample.

The number of treats sampled was small and not all of these bacterial strains have been shown to infect humans. However, the researchers advise all pet owners to wash their hands after touching such treats, as they would with any raw meat or raw meat diets. The very young, elderly, pregnant, immunocompromised and other high-risk individuals should avoid all contact with raw animal-product based treats and raw meat diets, note the scientists.

To learn more about veterinarian and pet owner perceptions of dog foods and treats, the research team developed a 20-question Web-based survey. The survey was posted online for public participation for 60 days and all responses were anonymous. It was completed by 852 adults from 44 states and six countries. Most respondents were female dog owners.

"We were surprised at the clear misconceptions pet owners and veterinarians have with pet foods and many of the popular raw animal-product based pet treats currently on the market," said Freeman. "For example, 71 percent of people feeding bully sticks to their pets stated they avoid by-products in pet foods, yet bully sticks are, for all intents and purposes, an animal by-product."

Another surprising finding was the large number of people who did not know what bully sticks actually were. A higher proportion of veterinarians (62 percent) were able to correctly identify the source of bully sticks as bull penis compared to general respondents (44 percent). Twenty-three percent of the respondents fed their dogs bully sticks.

Further research with a larger sample size is needed to determine whether the calorie content and contamination rate found in this study is representative of all bully sticks, or other types of pet treats, according to the authors.

Cub Scout pack drops gay-friendly policy amid pressure

A Cub Scout pack in Maryland has decided to jettison its gay-friendly membership guidelines under threat of losing its Boy Scouts of America charter, according to a statement on the pack?s website.

Pack 442 of Cloverly, Md., had adopted a non-discrimination policy that read: ?Pack 442 WILL NOT discriminate against any individual or family based on race, religion, national origin, ability, or sexual orientation.?

But over the weekend, the pack posted a notice on its website reading: ?Due to pressure from the National Capital Area Council of BSA, Pack 442 was forced to remove its Non-Discrimination statement in order to keep our Charter (set to expire Jan 31st). This Non-Discrimination statement, previously posted here, welcomed ALL families.?

The pack?s position ran counter to the Boy Scouts? membership guidelines, which ban openly gay members or leaders.?

Activist groups stepped up their campaign to end the longstanding ban last year after California teen Ryan Andresen was denied the Eagle rank because he is gay, and following the dismissal of Jennifer Tyrrell as den leader of her son?s Tiger Cub pack in Ohio because she is a lesbian.

Theresa Phillips, committee chair of Pack 442, said her group had the same motivations.

?I think we need to start at this level,? she told NBC News on Saturday. ?We need to teach the boys ? respect for other people and their lifestyles.?

A call placed to Phillips on Monday seeking comment on the removal of the policy was not immediately returned. It was not clear if the pack would continue to accept all families under a ?don?t ask, don?t tell? approach similar to the one used by the military until it was rescinded last year.

The pack?s member families approved the non-discrimination policy last August, and it was discussed in detail with district leaders and the regional council, to which the pack belongs, from August through October.

The issue appeared to be settled, but when the council ?contacted us a few weeks ago pressuring us to remove our statement, we attempted to negotiate a rewording of the statement that would represent a compromise on the matter, but ultimately NCAC leadership felt only removal of the statement would be acceptable,? the pack said on its website.

?It's clear to us that they chose this time to bring that up because they knew that we needed to recharter at the end of January,? Phillips said.

Scout Executive Les Baron, a council leader, confirmed to NBC News on Friday that the pack could lose its charter if it maintained the policy: The ?policy of the Boy Scouts are what they are and my job is to not bring into (it) my own personal feelings.?

The pack committee had been split on a way forward, which prompted a poll on whether they would keep the policy and possibly not be rechartered, or if they would remove it and return to a ?don?t ask, don?t tell? policy welcoming all families.

The poll, which ended Friday night and was conducted on the pack website, came out 53 percent in favor of reverting to ?don?t ask, don?t tell? and 47 percent backing the new policy, said Phillips, who voted in favor of explicitly including gays and lesbians. The poll had called for a two-thirds majority, she said.

The Boy Scouts reaffirmed its ban on gays and lesbians in 2012 following a two-year confidential review.

A national BSA spokesman, Deron Smith, said in an email on Friday that the private organization "has policies that all councils and local units agree to follow."

Russia says Assad's prospects fading

MOSCOW (Reuters) - Russia said the chances of Syrian President Bashar al-Assad staying in power were growing "smaller and smaller", as fighting on Sunday in southwestern Damascus shut a main highway from the capital.

Assad has long counted Moscow as an ally and Prime Minister Dmitry Medvedev's remarks were the most vocal Russian statement yet that his days may now be numbered, although they come after predictions from France, an avowed enemy, and from neighboring Jordan that the Syrian president's downfall is not imminent.

"I think that with every day, every week and every month, the chances of his preservation are getting smaller and smaller," Medvedev said, according to the transcript of an interview in Russian with CNN that was released by his office.

"But I repeat again, this must be decided by the Syrian people. Not Russia, not the United States, nor any other country," said Medvedev, whose administration has criticized Western, Turkish and Gulf Arab support for Syria's rebels.

"The task for the United States, the Europeans and regional powers ... is to sit the parties down for negotiations, and not just demand that Assad go and then be executed like Gaddafi or be carried to court sessions on a stretcher like Hosni Mubarak."

After Egypt's veteran president Hosni Mubarak was toppled, Russia withheld its veto on a U.N. Security Council resolution authorizing Western and Arab powers to provide military help to the rebels who overthrew Muammar Gaddafi in neighboring Libya.

Moscow has since accused the West of breaching sovereign rights and has vetoed U.N. action against Assad. Medvedev warned that removing Assad by force would mean "decades" of civil war.

Russia has been Assad's most important ally throughout the 22-month-old Syrian conflict, which began with peaceful street protests and evolved into an armed uprising against his rule.

Moscow has blocked three Security Council resolutions aimed at pushing him out or pressuring him to end the bloodshed which has killed more than 60,000 people. But Russia has also distanced itself from Assad by saying it is not trying to prop him up and will not offer him asylum.

The mainly Sunni Muslim rebels have seized territory in the north of the country, including several border crossings, and have challenged Assad's control over Syria's main cities.

But Assad's air power and army, whose senior ranks are dominated by his Alawite minority, have stemmed rebel advances.

France said on Thursday there was no sign Assad was about to be overthrown, reversing previous statements that he could not hold out long, and Jordan's King Abdullah said Assad would consolidate his grip for now.

"Anybody who is saying the regime of Bashar has got weeks to live really doesn't know the reality on the ground," Abdullah said in Davos on Friday. "They still have capability, so I give them a strong shot at least for the first half of 2013."

HIGHWAY CLOSED

Activists said rebels clashed with forces loyal to Assad in southwestern Damascus on Sunday, seizing a railway station and forcing the closure of the main highway to Deraa in the south.

Footage posted on the Internet showed what activists said was a rebel attack on the station in Qadam district. One clip showed gunmen taking cover as gunfire could be heard. Another showed gunmen inspecting buildings by the track after what the narrator describes as the "liberation" of the station.

Another video showed black smoke billowing above concrete buildings, the result of what activists said was an air strike by Assad's air force near the railway terminal.

Syrian media did not comment on the fighting around Qadam and restrictions on independent media make it difficult to verify reports from activists.

The Syrian Observatory for Human Rights, a British-based opposition group which monitors the violence in Syria, said jets and artillery also struck targets in rebel strongholds to the east and south of the capital after fierce clashes there.

The fighting came as United Nations humanitarian chief Valerie Amos visited Syria ahead of a U.N. aid conference in Kuwait which aims to raise $1.5 billion for millions of people made homeless, hungry and vulnerable by the conflict.

On Wednesday, Amos said Syrians were "paying a terrible price" for the failure of world powers to resolve the conflict, pointing to 650,000 refugees who have fled the country and the millions affected inside Syria.

"Four million people need help, two million are internally displaced and 400,000 out of 500,000 Palestinian refugees have been affected," she told an economic forum in Switzerland.

The United Nations and aid groups inside Syria, including the Syrian Arab Red Crescent, could not keep pace with the rising number of people in need, she said.

"We must find ways to reach more people, especially in the areas we are still unable to get to, and where there is ongoing fighting," she said.

Last month, the United Nations withdrew 25 of its 100 foreign aid workers from Syria as fighting intensified around Damascus, but Amos said it remained committed to maintaining aid work.

Most of the money from the Kuwait conference will go to support neighboring countries hosting hundreds of thousands of refugees, while $519 million is earmarked for aid inside Syria.

ISRAEL WARNING

The fighting has alarmed neighboring Israel, where Vice Prime Minister Silvan Shalom said that any sign that Syria's grip on its chemical weapons was slipping could trigger Israeli military strikes.

Should Lebanon's Hezbollah guerrillas or Syrian rebels obtain Syria's chemical weapons, "it would dramatically change the capabilities of those organizations," Shalom said.

Such a development would be "a crossing of all red lines that would require a different approach, including even preventive operations," he told Israel's Army Radio.

Assad has vowed to defeat rebels he describes as terrorists. In a speech three weeks ago he repeated his readiness for a national dialogue, but ruled out talking to "extremists who don't believe in any language but killing and terrorism".

State television said on Sunday that Syria's highest judicial council had suspended legal cases against Syrian opposition members so they can take part in talks - a proposal roundly rejected by most of Assad's opponents.

Medvedev said Assad did not appear to be ready for a negotiated solution to the crisis.

"He should have done everything much faster, attracting part of the moderate opposition, which was ready to sit at the table with him, to his side," the Russian premier said. "This was his significant mistake, and possibly a fatal one."

But he also warned of consequences if Assad is thrown out by force. He said: "Then the civil war will last for decades."

White House disagrees with court recess appointment decision

WASHINGTON (Reuters) - The White House on Friday said it disagrees with a U.S. federal appeals court's "novel and unprecedented" decision to reject President Barack Obama's "recess appointments" to a labor board last year, but declined to say whether the administration would appeal.

"We respectfully but strongly disagree with the rulings," White House spokesman Jay Carney said at a briefing. "There have been, according to the Congressional Research Service, something like 280-plus intra-session recess appointments by ... Democratic and Republican administrations dating back to 1867."

Carney referred questions about the administration's next steps to the Justice Department.

He also said the court decision was about one case and has no bearing on Richard Cordray, whom the president used a recess appointment to install as head of the Consumer Financial Protection Bureau.

He announced his plan to turn things around at the struggling department store.

Johnson was JCPenney's white knight. He had joined the retailer in late 2011, leaving his high-profile job as the retail chief at Apple.?

The brilliant mind behind the magnificent success of the Apple Store was supposed to be the century-old chain's savior.?

It's not nearly over yet ? his plan called for a few years of transition. But now, it has been one year since Johnson gave that presentation.?

JCPenney's stock is down 53 percent since then.
