'Girls Gone Wild's' Joe Francis Sends Legal Threat to Madonna Over ...

Rather than reveling in what could have been free publicity on the world's largest stage, "Girls Gone Wild" creator Joe Francis is sending threats to halftime performer Madonna.

In a Cease and Desist letter sent to Madge, NBCUniversal and NFL Commissioner Roger Goodell, obtained by TMZ, Francis' legal team demands that the queen of pop refrain from performing her new song "Girls Gone Wild" at this Sunday's Super Bowl.

"Your misappropriation of my clients' trademark will not be tolerated," threatens the letter, though Francis is apparently willing to cut a deal for the right price.

The song appears on the track list for Madonna's upcoming album, MDNA, though Francis may have ruffled his feathers a bit prematurely. According to a leaked set list courtesy of NFL magazine, Madge wasn't planning to play the song at all during her performance. Viewers can, however, expect to hear her latest single, "Gimme All Your Luvvin," as well as "Ray of Light" and, of course, "Vogue."

According to TMZ's original report, Francis had required a response from the singer by 5 p.m. PT on Friday, Feb. 3. At the time of publication, any potential response had not yet been made public.
